The email below was received by the Appeals Section of the Division of Employment Security, but we are unable to process what we received as an appeal as we are unable to ascertain what issue or issues you are trying to appeal.  As a result, we are returning this correspondence to you with no further action on our part.

If you were attempting to file an appeal, you must resubmit your request with a clear indication of your intention to file an appeal and specify which issue or issues you wish to appeal.  Please see below regarding the specifics necessary for appeals sent by email.  If your appeal will now be late, you can reference your earlier email and this response in your appeal statement or in any future hearing.

Pursuant to the DES Administrative Rules, for an appeal to be valid it must be in writing and shall contain the following: 1) the date of the appeal; 2) the issue identification number of the determination or issue being appealed; 3) the claimant's identification number; 4) the names of the claimant and employer; 5) each reason for the appeal; 6) the name of the individual filing the appeal; 7) the official position, if any, of an individual filing the appeal on behalf of the party; and 8) a telephone number.  04 N.C. Admin. Code 24C .0203. 

Filing an appeal via the DES website (des.nc.gov) is the fastest and most efficient way to file an appeal. Appeals filed via the DES website are automatically processed and routed to the Appeals Section for scheduling an appeals hearing, without the need for additional validation and with less chance of human error or delivery mistakes that might delay the process. Appeals filed via the DES website are automatically associated with names, issue identification numbers, and other important identifying information, so they take less time for you to complete and less time for DES to process. 

The appeal may be submitted online by logging into your DES website portal at des.nc.gov. For CLAIMANTS, select Claims from top menu. Then select View for NON-MONETARY DETERMINATIONS of your claim, select issue and then Request Appeal. For EMPLOYERS, select Appeal from top menu. Select issue then Request Appeal.

If you are unable or unwilling to file via our website, DES also accepts written appeals manually filed via postal mail, delivery service, fax, and email. The mailing address is DES Appeals, Post Office Box 27967, Raleigh, NC 27611-7967.  The physical address for delivery service is DES Appeals, 700 Wade Avenue, Raleigh, NC 27605.  The fax number for an appeal is (919) 341-5691 and be sure to include a cover sheet with your fax indicating you are filing an appeal.  The email address is des.public.appeals@commerce.nc.gov.  See 04 N.C.
